PURPOSE

Sani/Ikos Group (“SIG” or “we/us/our”) acknowledges and values the willingness of our guests (“you” or “the Contributor”) to share their personal experiences on social media and other platforms. SIG seeks to lawfully incorporate such user-generated content (“Content”) into its own marketing, promotional, informational, and corporate communications disseminated via its official digital properties, including but not limited to websites, mobile applications, email campaigns, and official social media accounts, as well as via selected third-party media platforms.

In this context, SIG may reach out to you through the platform where your Content was originally posted to request your permission for its use. You may provide your consent by replying with the designated hashtag, as outlined below. Please note that you are under no obligation to grant permission; if you do not wish to share your Content, you may simply disregard the message or respond with a refusal.

ACCEPTANCE OF TERMS

IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY. BY RESPONDING TO OUR REQUEST WITH THE HASHTAG (#) LoveIkos, YOU HEREBY EXPRESSLY CONSENT TO AND AGREE TO BE LEGALLY BOUND BY THE FOLLOWING CLAUSES:

  1. Definition of “Content”: For the purpose of this Agreement, “Content” shall mean any user-generated material provided or made accessible to SIG by you, including but not limited to photographs, videos, images (still or moving), graphics, illustrations, audio-visual elements, metadata, or any other material submitted or published in a visual or multimedia format.
  2. Representations and Warranties: By accepting this Agreement, you represent and warrant the following:
  • Age: You are at least eighteen (18) years of age
  • Minors: if the Content features a minor, you are either:
  • (a) the parent or legal guardian of the minor(s) depicted, or
  • (b) have obtained express written consent from the parent(s) or legal guardian(s) for the use of the Content by SIG.

You further acknowledge that SIG reserves the right to not use or to remove any such Content where the above-mentioned cannot be verified.

  • Ownership and Authority: You are the sole legal owner of the Content or otherwise possess all necessary licenses, rights, consents, and permissions to license the Content to SIG under the terms herein without infringing the rights of any third party.
  • Third-Party Rights: Where the Content includes the image or personal data of any third party, or has been created by multiple authors, you warrant that any such third party has granted you the necessary and lawful permission to include their likeness in the Content and to grant SIG the rights outlined herein.
  • Non-Infringement: The Content does not infringe upon any copyright, trademark, trade secret, privacy, publicity, intellectual property, or other proprietary rights of any third party, nor does it violate any applicable laws or regulations.
  1. Authorization for Use: You hereby grant to SIG, without restriction or compensation, a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to:
  • use, reproduce, host, store, copy, publicly display, publicly perform, stream, transmit, publish, disseminate, distribute, create derivative works from, adapt, modify, edit, and otherwise exploit the Content, in whole or in part, in any and all media formats and through any media channels, whether now known or hereafter developed;
  • use the Content alone or in combination with other materials, including for commercial, advertising, public relations, promotional, archival, or editorial purposes.

This Agreement specifically applies to Content that has been publicly posted by you on social media or other digital platforms. By responding to SIG’s request with the designated hashtag, you confirm that the Content has been made publicly accessible by you and that SIG’s use shall not infringe any platform terms or privacy expectations.

Nothing in this Agreement shall be construed to create any obligation on SIG to make actual use of the Content.

  1. Respect of reputation: SIG undertakes and agrees that its use, publication, or dissemination of the Content shall be carried out with due respect to the dignity, honour, and reputation of the individuals portrayed or otherwise affected. Under no circumstances shall SIG use the Content in any context or manner that is defamatory, degrading, misleading, offensive, or otherwise prejudicial to the personal, professional, or commercial interests of such individuals. Furthermore, SIG commits not to distort or manipulate the Content in a way that materially alters its meaning or context in a manner likely to cause harm to the Contributor’s image, values, or standing. This obligation shall remain in force throughout the duration of SIG’s use of the Content and shall survive any termination of this Agreement.
  2. No Compensation: You expressly acknowledge and agree that this license is granted voluntarily and without expectation of monetary compensation, future royalties, or any form of remuneration now or at any future time.
  3. Data Protection: Pursuant to Regulation (EU) 2016/679 (General Data Protection Regulation or GDPR), Greek Law 4624/2019, and Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights, SIG hereby informs you of the following:
  • Data Controller: Ikos Hotel Management S.M.S.A. 8 Chalkis Street, Pylaia, 555 35, Thessaloniki, Greece.
  • You may contact our Data Protection Officer (DPO) at: privacy@saniikos.com.
  • Purpose and Legal Basis: The processing of your personal data (including your image and any data contained in the Content) is based on your explicit consent, as evidenced by your affirmative response to SIG’s request with the hastag (#) LoveIkos.
  • You retain the right to withdraw your consent at any time by contacting SIG at privacy@saniikos.com. Upon verified request, SIG will make sure to cease future use of the Content and remove it from SIG-owned platforms within a reasonable time, unless such removal is impossible or requires disproportionate effort. Withdrawing your consent does not affect the lawfulness of any use of your content that occurred before the withdrawal, based on the consent you had previously given.
  • Data Sharing and Transfers: Your Content may be shared internally within the Sani/Ikos Group and with affiliated entities, both within and outside the European Economic Area (EEA), subject to appropriate safeguards, for the purpose of public communication and marketing.
  • Data Subject Rights: You have the right to request access to, rectification or erasure of your personal data, restriction of processing, portability of your data, and to object to processing. These rights may be exercised by contacting the DPO (privacy@saniikos.com).
  • Right to Lodge a Complaint: If you believe your rights under data protection law have been violated, you may file a complaint with the competent supervisory authority in your country of residence or in the jurisdiction of the data controller.
  1. Release of Liability: To the fullest extent permitted by applicable law, you agree to fully release, discharge, defend, indemnify, and hold harmless SIG, its officers, directors, employees, contractors, agents, licensees, successors, and assigns, from and against any and all claims, liabilities, demands, losses, damages, judgments, costs, and expenses (including reasonable attorneys’ fees), arising out of or related to SIG’s use of the Content in accordance with this Agreement. This clause shall survive the expiration or termination of this Agreement.
  2. Governing law and jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Greece, without regard to conflict of law rules. Any disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the competent courts of that jurisdiction. Nothing herein shall constitute a waiver of SIG’s rights under public domain, fair use, or similar doctrines under applicable law.
